Evolution — Umarizal, Belém/PA, CEP 66.055-200, operating under the name Star Grading Authenticator, hereinafter "SGA".
1.2. USER: The individual or legal entity that, after accepting these Terms, submits items to SGA for authentication and/or grading, hereinafter "User" or "Client".
2. Purpose
2.1. These Terms govern the provision by SGA of the following services:
- Authentication of TCG (Trading Card Game) collectible cards
- Technical grading on a scale of whole numbers from 1 to 10, plus the Gold Star 10+ distinction for the top range
- Classification A (Authentic) for authenticated items that do not receive a numeric grade
- Encapsulation in an acrylic slab with an ultrasonic seal
- Issue of a digital certificate with a QR code and a unique barcode
- A digital report with photos and subgrades
2.2. In this version of the service, SGA offers a single service level. The price is set by the number of items in the same submission, according to the table in force on SGA's website. In this version there are no options with different turnaround times.
2.3. SGA accepts the following categories of collectible cards: Pokémon TCG, One Piece TCG, Magic: The Gathering, Lorcana and Riftbound TCG. SGA reserves the right to widen or narrow the accepted categories with prior notice.
3. Registration and Access
3.1. To use SGA's services, the User must register on the portal, providing true, complete and up-to-date information, including full name or company name, CPF or CNPJ (Brazilian tax IDs), address and contact details.
3.2. The User is solely responsible for keeping their access credentials safe. SGA is not liable for improper access resulting from the User sharing or being careless with their passwords.
3.3. The User must have full legal capacity to enter into this contract. Persons under 18 must be represented by their parents or legal guardians.
3.4. SGA reserves the right to suspend or cancel registrations that contain false information or that violate these Terms, without prior notice and without any right to compensation.
4. Submission of Items
4.1. Declarations by the User
By submitting an item, the User expressly declares that:
- They are the legitimate owner of the item or have the express authorization of the owner to submit it.
- The item is authentic and has not been altered, restored, trimmed, washed, marked or tampered with in any way.
- The declared value is true and corresponds to the estimated market value of the item in its present condition.
- The item is not the subject of a lawsuit, a lien or any third-party claim.
- They are fully aware that grading is a technical opinion and not a guarantee of market value.
4.2. Prohibited Items
SGA will not accept the following for grading, and will return them ungraded and without a refund of the service fee:
- Counterfeits or fakes identified in the authentication inspection
- Trimmed cards (edges cut artificially)
- Cards that were washed, bleached or had their surface chemically treated
- Cards with restorations, touch-ups or interference with the original print
- Items already encapsulated in slabs of other grading companies (crossover is not accepted in this version of the service)
- Items not listed in the categories accepted by SGA
4.3. Packaging and Shipping
4.3.1. The User is fully responsible for packaging the items properly for shipment to SGA, and must follow the packaging instructions in the Shipping Guide published on SGA's website.
4.3.2. The following are strongly recommended: a penny sleeve, a rigid toploader, cardboard on all four sides, and shipping by SEDEX (the express service of the Brazilian post office) with declared insurance in proportion to the value of the items.
4.3.3. SGA takes no responsibility for damage that occurs during transport to SGA. Damage found when the package is opened will be photographed and reported to the User before any procedure.
4.3.4. The cost of and the responsibility for shipping to SGA are the User's. Return shipping is included in the price of the services, as described in the table of services.
4.3.5. Items are returned to the User with mandatory insurance, taken out on the declared value. The insurance costs 3% (three percent) of the sum of the declared values of the items in the submission, is charged together with the service, in the same payment, and cannot be waived.
4.3.6. The declared value of each item is stated by the User in the submission, must be greater than zero, and is the basis for the return insurance and for the compensation limit of clause 7.2.1.
5. The Grading Process
5.1. SGA's grading is based on four technical categories: Centering, Corners, Edges and Surface. Each category receives a percentage of its own, and the final grade is given on a scale of whole numbers from 1 to 10, plus the Gold Star 10+ distinction for the top range. There are no fractional grades.
5.2. The overall percentage of the item is the average of the four categories. Three rules act on that average, always in the direction of lowering the grade: the final grade does not exceed the grade of the worst category by more than one level; creases and dents impose a ceiling of their own on the grade; and the Gold Star 10+ distinction requires a minimum percentage in every category, no structural defect and no damage above the minimum severity. The published grade may therefore be lower than the average of the categories would suggest, never higher.
5.3. Authenticated items that do not receive a numeric grade are identified with the classification A (Authentic).
5.4. The numeric parameters of the rules above are set out on the Grading Criteria page, which is an integral part of these Terms for the purposes of clause 7.1.
5.5. Grading is a technical opinion issued by SGA's specialists and is not an appraisal of financial value, a guarantee of resale or an official governmental certification of authenticity.
5.6. SGA reserves the right to refuse to grade any item, at any time, at its sole discretion, informing the User of the reason.
5.7. Items identified as altered or counterfeit during the process will not be returned encapsulated. SGA may, at its discretion, retain the item and notify the competent authorities where there is evidence of fraud, under Law No. 8,137/1990 and the Brazilian Penal Code.
5.8. SGA will keep a photographic record of all items received and processed, linked to the order number and to the certificate issued.
6. Turnaround Times
6.1. The turnaround time indicated by SGA, of up to 30 (thirty) days, is an estimate and is not a contractual guarantee. It starts to count from the confirmation of receipt and verification of the items by SGA.
6.2. Factors that may affect turnaround times include: a high volume of submissions, holidays, logistics problems, doubts about authenticity and events of force majeure.
6.3. SGA will proactively inform the User of any significant delay, by the registered email.
6.4. In the event of a delay of more than 30 (thirty) days beyond the estimated time communicated to the User, the User will be entitled to cancel the service with a full refund of the amounts paid and to have the items returned, at their choice.
7. Liability and Limitation of Liability
7.1. SGA's Liability

7.2.2. For items worth more than R$ 5,000.00 (five thousand reais), the User must declare the real value and take out additional insurance with SGA or provable by a policy of their own. SGA is not liable for amounts above the limit stated above without adequate insurance.
7.2.3. SGA is not liable for:

8.1. The User may cancel the order at no cost until SGA receives the items, by a formal request by email or through the portal.
8.2. After receipt and the start of processing, cancellation will not give rise to a refund of the service fee, but the item will be returned to the User without encapsulation.
8.3. In accordance with Article 49 of the Brazilian Consumer Defense Code, a User who contracted the service exclusively by electronic means has a right of withdrawal within 7 (seven) calendar days from the date of contracting, provided the items have not yet been sent to SGA.
8.4. Approved refunds will be processed within 15 (fifteen) business days, and the refund is made by the same means as the payment, through Mercado Pago.
9. Intellectual Property and Use of Images
9.1. The photographs, reports and data generated by SGA in the grading process are the property of SGA, and the User is guaranteed access to and non-commercial use of the images of their own items.
9.2. The User expressly authorizes SGA to use the images of the graded items for institutional purposes, marketing, demonstration of quality and publication on social media, without identifying the User, unless the User expressly opts out in writing.
9.3. The SGA brand, the logo, the grading system, the design of the slab, the label standard and all the content of the portal are the exclusive property of SGA and are protected by Brazilian intellectual property law (Law No. 9,279/1996).

10.2. The User's data will be used exclusively for: performing the contracted services, communications related to the order, compliance with legal obligations and, with specific consent, sending marketing communications.
10.3. The User has the right to access, correct, delete and port their data, by a request to the email privacidade@stargrading.com.br.
11. General Provisions
11.1. SGA reserves the right to change these Terms at any time, informing the User at least 10 (ten) days in advance by the registered email. Continued use of the services after the date on which the changes take effect implies tacit acceptance of the new terms.
11.2. SGA's tolerance of any failure to comply with a provision of these Terms does not imply waiver or novation, and SGA may require compliance at any time.
11.3. If any clause of these Terms is declared invalid or unenforceable, the remaining clauses will stay in full force.
11.4. This contract is governed by the laws of the Federative Republic of Brazil.
